Top 10 Legal Issues with Creating, Providing and Using Software
May 2, 2019 – During this event, we discussed the top 10 legal issues facing any business that uses, creates or provides software and how to avoid them. It was made possible by our partnership with the Phyfer Innovation Hub, in conjunction with the Clemson MBA Program.
Doug Kim, founding partner of the Kim & Lahey Law Firm and Andy Kurtz, President and CEO of Kopis, provided valuable insight. Doug is a former computer engineer and was named 2019 Best Lawyer of the Year for Patent Law in Greenville. Andy is a software developer and entrepreneur who started Kopis (formerly ProActive Technology) 20 years ago. Together with his team, he has successfully delivered solutions for firms from startups to Fortune 500 companies.
Doug says his practice is seeing an increase in software license disputes between software vendors and users. It’s a trend that is expected to continue. The main reason for the increase, Doug says, is the change in technology, which has changed the way in which software is created, distributed and used. This problem is aggravated by either current license agreements not being updated to reflect these changes or by vendors making license terms more burdensome for users.
Doug and Andy went through a comprehensive presentation to discuss the issues, provide examples and give tips for ways to avoid software disputes. You can download a copy here. The biggest takeaway? Attendees said the section about the changes in copyright law were surprising. Tina Flores said, “I had no idea! That was a great presentation. I learned a lot from both of them. Thank you!”
